07/19/19 – The City of San Antonio “Paid Sick Leave Ordinance” (pdf) is set to go into effect on August 1, 2019. This ordinance covers all private employers with six or more employees who perform, minimum, 80 hours of work within the city limits.
For small employers with five or fewer employees, the ordinance goes into effect on August 1, 2021.
For those employers who have a PTO policy in place and meet the minimum requirements of the ordinance (see below), it will be considered as in compliance and not necessary to have a separate sick leave accrual.
Just last week the Austin Paid Sick Leave law was struck down as unenforceable and does not apply anymore. A group of San Antonio businesses filed a lawsuit Monday, July 15 to block the policy from taking effect in a similar fashion; a preliminary hearing for this lawsuit is set for July 24.
